Memorandum of Settlement: 2006

The following represents the agreement between NSS and The Society to settle all items presented by both parties during this round of negotiations.

85 EXTRAMURAL TRAINING
Replace 85.2 Professional Fees with the following:
85.2 Professional Development Fund
NSS will make available funds to Society represented staff that can be self-directed to meet their individual development needs. The purpose of these funds is to encourage staff to continue their development by enabling them to purchase the following:
1. Membership in a professional organization, e.g., membership of PEO, CNS, etc,
2. Relevant Technical Books,
3. Technical Journals/Magazines, and
4. Other expenditures that would aid the individual's development, to be pre-approved by management.
These items are paid via a single expense report accompanied by receipts, to be submitted by December 1 of each year for expenses incurred in that calendar year. Technical books, technical journals/magazines and other such items are to be registered in the NSS Document Registry. Each staff may spend up to $250.00 per annum. Staff must consult with their supervisor regarding the nature of the expenditure and obtain prior approval before committing any expenses.

PART IX  HEALTH BENEFITS
Add to Article 46 Extended Health Benefits (EHB) the following items and increased values:

46 EXTENDED HEALTH BENEFITS (EHB)
Effective April 1, 2006, the following changes apply:
1. Chiropractor services covered up to $650 per year,
2. Hearing aid batteries covered up to $100 per year,
3. Orthodontic services covered up to a maximum of $5000 per lifetime,
4. Orthotics covered to a maximum of $450 once every three years. For children under 18, orthotics covered to a maximum of $450 per year,
5. Vision care (eyewear and contact lenses) covered to a maximum of $500 every two years. If vision deteriorates to an extent requiring new prescription eyewear during the two years, additional coverage of $200 (Le., to a maximum of $700) is provided.
Add New Arlicle 46.4 - Fitness Memberships
46.4 Fitness Memberships
This initiative is designed to promote regular physical fitness activity. NSS will reimburse employees up to $156.00 per calendar year on a pro rated basis for fitness club memberships. Claims are to be submitted in December of each year for that calendar year's expense. All claims must be accompanied by receipts and are subject to management approval.

38 VACATIONS
Amend Article 38.1 Vacation Entitlement
38.1 Fitness Memberships Vacation Entitlement
The combination of Vacation Commencement (VCD) plus External Experience Value (EEV) determines service for vacation entitlement for the purpose of this Article.
Subject to a supervisor's approval as to timing, employees who have 15 days vacation or less will be entitled to accumulate 5 days of Time Off In Lieu (TOIL) to supplement their vacation. This vacation equivalent TOIL may not be carried over into the next calendar year.

35 PAID/UNPAID TIME OFF
35.2 Funeral Leave
Amend 35.2 (a) to include common law spouse and same sex spouse.
Delete Section 35.2 (b) Federally Regulated t;=mployees, subsections (i), (ii) & (iii) in their entirety.

75 TELEWORKING
Add New Section
75.4 As distinct from Teleworking as defined in this article, NSS may at its discretion, authorize employees to work from home. The application of this provision is limited to circumstances which are not regular events. This provision is intended to address situations where it is impractical to commute to the workplace and working from home accommodates the employee's need yet still allows for work to be completed effectively.
Where the employee has prior knowledge of an event for which they wish to have considered under this provision, or in respect of an ad hoc event, they are to advise their supervisor as soon as practical.
The application of this provision is also subject to IT system capability to support working from home.

56 ON-CALL SERVICE
56.2 Payment
Amend subsections 56.2.2,56.2.3, and 56.2.4 as follows:
On-call payments will be increased by an amount equal to the percent economic increase to base salary schedules that is effective on April 1 of each year of this Agreement.
Specific amounts will be published in the Collective Agreement when printed.

59 SHIFT WORK (M&P)
59.3 Shift Allowances (M&P)
Amend subsection 59.3 b) Shift Differentials as follows:
Shift Differentials payments will be increased by an amount equal to the percent economic increase to base salary schedules that is effective on April 1 of each year of this Agreement.
Specific amounts will be published in the Collective Agreement when printed.

50 PENSION PLAN
Replace 50. 10 Employee Contribution Holiday with the following:
50.10 Pension Contribution Holiday
At any time during the period that this collective agreement is in effect and that either NSS or the PWU members stop their contributions to the pension plan, the Society will be given the opportunity to stop contributions from Society represented pension plan members for an equivalent period of time.
This article refers specifically to contribution holidays due to the surplus status of the pension fund.
This provision does not require the implementation of a contribution holiday.
Add to 50. 11 Plan Formula
50.11 Plan Formula
Effective April 1, 2006, employee contributions will increase to 6.5%.
Effective January 1, 2009, employee contributions will decrease to 4.5% up to YMPE and 6.5% above YMPE.
Term of the Agreement
The Collective Agreement will be for a three (3) year term from April 1, 2006 to March 31, 2009.

23 SALARY SCHEDULES
Amend section 23.2 as follows:
The salary schedule will be adjusted by the following economic increases:
  • Effective April 1, 2006   3.00%
  • Effective April 1, 2007   3.00%
  • Effective April 1, 2008   3.00%
24 ESCALATOR CLAUSE
Amend 24.2 as follows:
24.2 The parties have agreed for the term of this agreement to include an escalator clause in the second and third years of the agreement. This provision will terminate as of March 31 2009 and will not be automatically renewed. The escalator clause may generate a maximum of one payment on April 1, 2008 and one payment on April 1, 2009 and none thereafter.
In the second year of the Collective Agreement namely, April 1, 2007 to March 31, 2008 the following formula shall apply:
(a) An increase of more than the economic increase effective April 1, 2007 in the Canada All Items I ndex (Total CPI 1992 = 100) published by Statistics Canada for February 2007 (published in March 2007) over the index for February 2006 (published in March 2006) will activate the escalator clause.
(b) A lump sum payment will only be made when the change in CPI as calculated in (a) above exceeds the economic increase by 0.5%. The actual amount paid will be the difference between the change in CPI and the economic increase that is effective on April 1, 2007. In no case shall the total amount of such increase exceed 1 %.
e.g., Annual Index = 3.5%, payment = 0.0%
Annual Index = 3.55%, payment = 0.55%
Annual Index = 4.1 %, payment = 1.0%
In the third year of the Collective Agreement namely, April 1,2008 to March 31, 2009, the following formula shall apply:

32 PERFORMANCE PAY PLAN
Amend Section 32.2 as follows:
32.2 Performance Payouts
NSS will make the following minimum performance payouts:
  • 1.75% of base pay as at March 31 2007, to be effective April 1 ,2007
  • 1.75% of base pay as at March 31 2008, to be effective April 1, 2008
  • 1.75% of base pay as at March 31 2009, to be effective April 1, 2009
For employees who are at or above 100% reference point of their salary grade, NSS may award a minimum performance payout of 1 %.
Collective Agreement Clean Up
Delete the following provisions:
Article 7 - Mid-Term Agreements
Article 74 - Assignment of Non-Bargaining Unit Work During Strike/Lockout
Appendix III - Unit of Application
Appendix IV - Application of PSA to AECL
Appendix VI - Project Crews
